A two-restaurant development at 1250 Ogden Ave. in Downers Grove needs another year to finish, and the developer is asking the Village Council to make it official.
The extension request, first reported by Patch, will go before the council at its Tuesday, Oct. 20, meeting at 7 p.m. at Village Hall, 850 Curtiss St. An ordinance submitted by Village Manager David Fieldman would amend the redevelopment agreement between the village and 1250 Ogden, LLC to push the completion deadline from Dec. 31, 2026, to Dec. 31, 2027.
The delay traces to a slow permitting process with the Illinois Department of Transportation (IDOT). Village documents state the developer "has actively pursued completion of the project" but that "progress has been delayed due to a slower than expected IDOT permitting process." The IDOT permit has since been obtained, and construction is described as "well underway," according to the village ordinance.
The project is not new to the council. Trustees approved the original redevelopment agreement with 1250 Ogden, LLC on March 4, 2025. Patch covered the proposal when it came before trustees in February 2025. The plan calls for a 9,600-square-foot building with two restaurant tenants and a drive-through, replacing the existing structure on the site.
Indvestia Capital manager Vick Mehta is the petitioner behind 1250 Ogden, LLC. In April, Mehta wrote to village officials that delays were caused by "circumstances beyond our control," including timing issues with IDOT approvals, Patch reported. At that point, the company had not yet secured a building permit and sought a six-month extension of its special use permit for the drive-through.
The project sits in the Ogden Avenue Tax Increment Financing (TIF) District. Under the agreement, the village would reimburse the developer for TIF-eligible expenses up to $1.2 million or half the development's cost, whichever is greater, according to Patch.
The two restaurant spaces must total at least 3,200 square feet combined, with minimum 10-year leases, per the ordinance.
The TIF district is a village priority. A staff report prepared for the same meeting lists "Close Ogden TIF" as a yellow-status item on the village's 2025–27 long-range plan, meaning the timeline is at risk.
The village has executed redevelopment agreements totaling $6.35 million across five Ogden Avenue projects, including the 1250 Ogden deal.
The amended agreement sets property acquisition by May 15, 2026, construction start by June 30, 2026, and substantial completion by Dec. 31, 2027. If the developer misses the new deadline, either party can exercise termination rights under the agreement.
The ordinance is listed as a first reading, with village staff recommending it move to the Nov. 17 agenda for a final vote.
